1. INTRODUCTION

Welcome to Callistry AI (“we”, “us”, or “our”), a service provided and operated by Creative Island FZ-LLC, based in Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates. By accessing our website (www.callistry.app) or using our AI-powered services, you agree to be legally bound by these Terms and Conditions (“Terms”), including our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of our services immediately.

2. ELIGIBILITY

You must be at least 18 years old to use Callistry AI. By using our services, you confirm that you are legally capable of entering into binding contracts on behalf of your business or organization.

3. SERVICES

• AI-powered voice agents for outbound/inbound calls
• Call recording, transcription, and live streaming
• Calendar booking and CRM syncing
• Integration with external platforms via webhooks or API
• Affiliate program access (upon approval)

We reserve the right to add, modify, or remove features at any time.

4. USER ACCOUNTS

You are responsible for maintaining the confidentiality of your account and login credentials. Any actions taken under your account are your responsibility. We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

5. ACCEPTABLE USE

You agree not to:

• Use Callistry AI for unlawful, fraudulent, or harassing purposes
• Send unsolicited or spam communications
• Tamper with or reverse-engineer our technology
• Misrepresent your identity or collect data without consent
• Overload, damage, or disable our infrastructure

Violations may result in termination and legal action.

6. PAYMENT & SUBSCRIPTIONS

All fees are payable in advance. Subscription plans auto-renew unless canceled before the next billing cycle. We accept credit card and approved digital payments. Setup fees and one-time payments are non-refundable unless otherwise stated.

7. FREE TRIALS

We may offer free trials at our sole discretion. Billing may begin automatically at the end of a free trial unless canceled beforehand.

8. GUARANTEE & REFUND POLICY

We offer a 30-day conditional money-back guarantee ONLY IF:

• You submit verifiable CRM data showing no +50% increase in booked appointments vs the previous 60 days
• You placed a minimum of 100 calls via Callistry to different leads
• You completed onboarding and used the platform as instructed

Refunds are subject to manual review and approved solely at our discretion. Abuse or fraudulent claims void all rights to a refund.

9. AFFILIATE PROGRAM

Approved affiliates may earn commissions through tracked referrals. By participating, you agree to:

• Use only approved messaging and creatives
• Disclose affiliate relationships (as required by law)
• Avoid spam and misleading claims

Violation leads to termination and forfeiture of commissions.

10. TESTIMONIALS & CASE STUDIES

All testimonials shown are submitted voluntarily and reflect individual experiences. We reserve the right to edit, reproduce, or remove testimonials at any time. You may not submit false or misleading reviews.

11. DATA COLLECTION & RECORDING

All calls through Callistry AI may be recorded, streamed, or transcribed. You agree to:

• Obtain required consent before using our recording tools
• Use the data ethically and lawfully
• Indemnify Creative Island FZ-LLC against legal claims related to misuse of recordings

12. GDPR & DATA PROTECTION

We comply with the General Data Protection Regulation (EU 2016/679). You may request:

• Access, correction, or deletion of your personal data
• Restriction or objection to processing
• Data portability (where applicable)

13. INTELLECTUAL PROPERTY

14. LIMITATION OF LIABILITY

Our liability is limited to the amount paid for the current billing cycle.

15. TERMINATION

We may suspend or terminate access to the platform at any time, with or without notice, if we believe these Terms have been violated. Upon termination, your access will be revoked and stored data may be deleted.

16. CHANGES TO TERMS

We may revise these Terms at any time. The latest version will always be posted on www.callistry.app. Continued use of the service after changes implies acceptance.
